Please read these terms carefully before using our website, participating in our programmes, making a donation, or becoming a member of KindNest Care Foundation. Your use of our services constitutes acceptance of these terms.

Definitions

The following terms shall have the meanings ascribed to them throughout this agreement:

"KCF" / "We" / "Us"
KindNest Care Foundation, a registered humanitarian non-governmental organisation based in Lagos, Nigeria, formerly known as Matured Minders Initiative for the Less Privileged.
"Website"
The website located at kindnestcarefoundation.com and all associated subdomains, pages, and digital platforms operated by KCF.
"User" / "You"
Any individual or entity accessing the Website, registering as a member, making a donation, submitting a volunteer application, or interacting with KCF through any channel.
"Services"
All humanitarian programmes, membership facilities, donation processing, volunteer coordination, events, publications, and digital tools made available by KCF.
"Content"
All text, images, videos, graphics, logos, audio files, data, reports, press releases, blog posts, and any other material published or distributed by KCF.
"Member"
Any individual who has completed the KCF membership registration process, paid applicable dues (where applicable), and been accepted into the KCF community.
"Volunteer"
Any individual who has submitted a volunteer application, been accepted by KCF, and participates in KCF programmes and activities without financial compensation.
"Donation"
Any voluntary monetary contribution made by an individual or organisation to KCF in support of its humanitarian mission, processed via Paystack or other approved channels.

Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and KindNest Care Foundation. By taking any of the following actions, you confirm your full and unconditional acceptance of these Terms:

  • Accessing, browsing, or using any page of our Website
  • Registering for KCF membership or submitting a membership application
  • Making a donation through any KCF-approved channel
  • Submitting a volunteer application or participating in any KCF programme
  • Subscribing to our newsletter or communications
  • Engaging with KCF through WhatsApp, social media, or any other digital channel
  • Attending any KCF event, outreach, or gathering

Age Requirement: You must be at least 18 years of age to independently accept these Terms, make donations, or register as a member. Individuals under 18 may participate in KCF programmes only with the consent and supervision of a parent or guardian who accepts these Terms on their behalf.

These Terms apply alongside our Privacy Policy, which is incorporated by reference and forms part of this agreement.

Use of Our Website

KCF grants you a limited, non-exclusive, non-transferable, revocable licence to access and use our Website for personal, non-commercial purposes in accordance with these Terms.

  • Making donations through our payment portal
  • Registering for membership or volunteering
  • Downloading materials explicitly marked for public use
  • Sharing links to our pages on social media
  • Contacting us through our forms and channels

❌ Prohibited Uses

  • Reproducing or republishing our content without permission
  • Using automated bots, scrapers, or crawlers
  • Attempting to hack, disrupt, or gain unauthorised access
  • Impersonating KCF or its representatives
  • Using the site for commercial solicitation
  • Uploading malware, viruses, or harmful code

3.1 Website Availability

KCF does not guarantee that the Website will be available at all times. We reserve the right to suspend, withdraw, or restrict access to any part of the Website for maintenance, updates, or any other reason without notice. KCF shall not be liable for any disruption or unavailability of the Website.

3.2 Accuracy of Information

While we strive to keep our Website content accurate and up to date, we do not warrant that all information is complete, current, or error-free. Programme details, statistics, and event information are subject to change. Always verify critical information by contacting us directly.

Membership Terms

KCF membership is open to individuals who share our humanitarian values and commit to supporting our mission. By registering as a member, you agree to the following:

4.1 Membership Obligations

  • Provide accurate, complete, and truthful information during registration
  • Notify KCF promptly of any changes to your registration details
  • Uphold KCF's values of kindness, integrity, transparency, and community service
  • Pay applicable membership fees or dues as communicated at the time of registration
  • Abide by the KCF Code of Conduct (see Section 9) at all times
  • Not use your membership status for personal commercial gain or to misrepresent KCF

4.2 Membership Benefits

Membership benefits are communicated on the KCF membership page and may be revised from time to time. KCF reserves the right to modify, add, or remove benefits with reasonable notice to members.

4.3 Membership Fees

Where applicable, membership fees are non-refundable except where KCF has been unable to deliver the core membership services for a sustained period through our own fault. Fee structures are published on the membership registration page and may be reviewed annually.

4.4 Membership Suspension or Termination

KCF reserves the right to suspend or terminate any membership without refund where a member:

  • Provides false information during registration
  • Brings KCF into disrepute through conduct or public communication
  • Violates these Terms or the KCF Code of Conduct
  • Engages in fraudulent, deceptive, or harmful behaviour toward KCF, its staff, beneficiaries, or members

Appeals: Members who believe their membership was terminated unfairly may submit a written appeal to KCF within 14 days of notification. Appeals are reviewed by KCF leadership and a decision communicated within 30 days.

Donations & Payments

KCF is a humanitarian NGO that relies on voluntary donations to fund its programmes. We are committed to being transparent stewards of every contribution entrusted to us.

5.1 Voluntary Nature of Donations

All donations made to KCF are voluntary and given without expectation of material return. By making a donation, you confirm that:

  • The funds are yours to give and are not derived from illegal or fraudulent activities
  • You are not making the donation under duress or undue influence
  • You are aware that donations are used to fund KCF's humanitarian mission

5.2 Refund Policy

Donations are generally non-refundable as they are immediately allocated to programme delivery. However, refunds may be considered in the following exceptional circumstances:

  • A donation was made in error (e.g. wrong amount or duplicate transaction)
  • A technical fault by KCF or our payment processor caused an unintended charge
  • The donation was made fraudulently without the account holder's authorisation

Refund requests must be submitted in writing to [email protected] within 7 days of the transaction date, with your transaction reference and supporting details.

5.3 Payment Processing

All transactions are processed by Paystack, a PCI DSS-compliant payment gateway. KCF does not store your card details. By donating, you also agree to Paystack's terms of service. Transaction fees charged by Paystack may be deducted before funds reach KCF.

5.4 Use of Donations

Donations are used to fund KCF's humanitarian programmes including child welfare, education support, healthcare outreach, and community feeding. KCF is committed to transparent reporting of fund utilisation through annual impact reports published on our website.

Anti-Fraud Notice: KCF will never contact you to request your bank PIN, card number, or password. Any such request claiming to be from KCF should be reported immediately to [email protected].

Volunteering Terms

KCF welcomes individuals who wish to contribute their time, skills, and energy to our mission. Volunteering with KCF is subject to the following terms:

6.1 Volunteer Agreement

  • Volunteering with KCF is entirely voluntary and unpaid unless a specific stipend arrangement is separately agreed in writing
  • Volunteers must complete the official application process and be formally accepted by KCF before participating in activities
  • Volunteers represent KCF in the community and must conduct themselves in accordance with Section 9 (Code of Conduct) at all times
  • KCF reserves the right to decline or terminate a volunteer engagement at any time without providing reasons

6.2 Health, Safety & Liability

Volunteers participate in KCF field activities at their own risk. While KCF takes reasonable steps to ensure safe programme environments:

  • Volunteers are responsible for ensuring they are medically and physically fit for the activities they undertake
  • KCF does not provide personal accident insurance for volunteers unless specifically stated for a programme
  • Volunteers in field environments must follow all health and safety briefings provided by KCF programme leads
  • KCF shall not be liable for personal injury, illness, or property damage sustained during volunteer activities unless caused by KCF's proven gross negligence

6.3 Photography & Media Consent

By volunteering with KCF, you consent to being photographed or filmed during programme activities for use in KCF's communications, reports, social media, and fundraising materials. If you wish to opt out, please notify us in writing before the activity.

Content & Intellectual Property

All content on the KCF Website — including but not limited to the KindNest Care Foundation name, logo, slogans, written articles, photographs, videos, infographics, programme reports, and design elements — is the exclusive intellectual property of KindNest Care Foundation unless otherwise stated.

7.1 Ownership

KCF's content is protected by Nigerian copyright law, international intellectual property conventions, and applicable treaties. Unauthorised use, reproduction, distribution, or modification of our content is strictly prohibited.

7.2 Permitted Use

You may share links to our content and reproduce short extracts (not exceeding 100 words) for non-commercial purposes provided that:

  • Clear attribution is given: "Source: KindNest Care Foundation — kindnestcarefoundation.com"
  • The content is not altered, distorted, or presented out of context
  • It is not used in a way that suggests endorsement by KCF of a product, service, or viewpoint

7.3 Press & Media

Accredited journalists and media professionals seeking to use KCF content should refer to our Press & Media page and contact our communications team for permission and official assets.

KCF Brand: The KindNest Care Foundation name, logo, and visual identity may not be used in any external publication, campaign, fundraiser, or commercial activity without prior written approval from KCF leadership.

User Submissions & Communications

When you submit content to KCF — including form submissions, volunteer applications, written testimonials, photographs, feedback, comments, or messages sent via email, WhatsApp, or social media — you agree that:

  • The content is original, accurate, and does not infringe the rights of any third party
  • You grant KCF a non-exclusive, royalty-free, worldwide licence to use, publish, and distribute such content in connection with our charitable activities
  • KCF may edit, format, or translate the content for clarity and appropriate presentation without changing its essential meaning
  • You will not submit content that is false, defamatory, offensive, abusive, discriminatory, or violates any applicable law
  • KCF reserves the right to reject or remove any submitted content at its sole discretion without explanation

KCF does not claim ownership of content you submit but you acknowledge that by submitting it, you waive any claim to compensation for its use in our communications and publications.

Code of Conduct

All individuals who interact with KCF — whether as members, volunteers, donors, event attendees, or online participants — are expected to uphold the following standards of conduct, which reflect KCF's core values of kindness, dignity, integrity, and community.

9.1 Expected Standards

  • Treat all KCF staff, beneficiaries, volunteers, and community members with respect and dignity at all times
  • Refrain from any form of discrimination, harassment, bullying, or intimidation based on gender, age, ethnicity, religion, disability, or socioeconomic status
  • Protect the privacy and dignity of KCF beneficiaries, especially children, at all times
  • Represent KCF truthfully and accurately in public communications and social media
  • Report any safeguarding concerns, misconduct, or suspected fraud to KCF leadership immediately
  • Comply with all applicable laws and regulations while engaging with KCF

9.2 Child Safeguarding

KCF operates a strict Child Safeguarding Policy. All volunteers, members, and partners who work directly with child beneficiaries must read and sign the Child Safeguarding Policy before commencing activities. Any individual found to have engaged in behaviour that harms, exploits, or endangers children will be immediately removed from KCF activities and reported to the appropriate authorities.

Zero Tolerance: KCF operates a zero-tolerance policy toward sexual exploitation, abuse, harassment, and any form of harm against children or vulnerable adults. Violations will be reported to law enforcement without exception.

Disclaimers

To the fullest extent permitted by applicable Nigerian law, KCF provides its Website and Services on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Website will be error-free, uninterrupted, or free of viruses
  • Warranties regarding the accuracy, completeness, or timeliness of any content
  • Warranties that third-party links will be available or suitable for your needs

Information published on this Website (including programme details, statistics, and beneficiary data) is provided for general informational purposes only and should not be relied upon as professional advice in any specific legal, financial, medical, or other context.

Limitation of Liability

To the fullest extent permitted by Nigerian law, KindNest Care Foundation, its officers, directors, employees, volunteers, and agents shall not be liable to you or any third party for:

  • Any indirect, incidental, consequential, special, or punitive damages arising from your use of the Website or Services
  • Loss of data, revenue, goodwill, or business opportunities in connection with our Services
  • Any actions, omissions, or content of third-party platforms linked from our Website
  • Any interruption, suspension, or cessation of our Website or Services
  • Any unauthorised access to or alteration of your data transmitted to or from our Website
  • Any harm arising from your voluntary participation in KCF field or outreach activities, except where caused by KCF's proven gross negligence or wilful misconduct

Where liability cannot be wholly excluded under Nigerian law, KCF's aggregate liability to you for any claim shall not exceed the total amount of any donation made by you to KCF in the 12 months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless KindNest Care Foundation, its leadership, staff, volunteers, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms or any applicable law or regulation
  • Your submission of false, misleading, or infringing content to KCF
  • Your violation of the rights of any third party, including intellectual property, privacy, or personal rights
  • Your conduct during KCF events, outreach programmes, or volunteer activities
  • Any misrepresentation made by you in connection with your relationship with KCF

Third-Party Links & Services

Our Website may contain links to third-party websites and platforms including Paystack, social media networks, partner organisations, and media outlets. These links are provided for your convenience and information only.

  • KCF does not endorse, control, or take responsibility for the content, accuracy, or practices of any third-party website
  • Accessing third-party platforms from our Website is at your own risk and subject to their respective terms and privacy policies
  • The presence of a link does not imply a partnership, sponsorship, or affiliation between KCF and the linked entity

Termination & Suspension

KCF reserves the right, at its sole discretion and without prior notice or liability, to:

  • Suspend or terminate your access to the Website or any part of our Services
  • Cancel your membership or volunteer status
  • Remove any content you have submitted
  • Take legal action where your conduct has caused harm to KCF, its beneficiaries, or other members

Grounds for termination include, but are not limited to, breach of these Terms, fraudulent activity, conduct unbecoming of the KCF community, or any action that damages KCF's reputation or operations.

Upon termination, all licences granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination (including Sections 7, 10, 11, 12, and 15) shall continue to apply.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

15.1 Dispute Resolution Process

  1. Direct Resolution: In the event of any dispute arising out of these Terms or your relationship with KCF, you agree to first contact us in writing to seek an amicable resolution before pursuing formal proceedings.
  2. Mediation: If a dispute cannot be resolved within 30 days of written notification, either party may request non-binding mediation conducted by a mutually agreed mediator in Lagos, Nigeria.
  3. Litigation: If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

Our Preference: KCF always prefers to resolve any concerns informally and directly. We encourage you to reach out to us first — most issues can be resolved quickly through open communication.

Changes to These Terms

KCF reserves the right to update, revise, or replace these Terms at any time to reflect changes in our operations, legal obligations, or best practices. When material changes are made:

  • The revised Terms will be posted on this page with an updated "Effective Date"
  • Registered members and newsletter subscribers will be notified by email of significant changes
  • Your continued use of the Website or Services after the effective date constitutes your acceptance of the revised Terms
  • If you do not agree to the revised Terms, you must cease using our Services and notify us if you wish to terminate your membership

We encourage you to review these Terms periodically. The version number and effective date at the top of this page will always indicate whether changes have been made since your last review.
